Government and budgetary institutions are required to purchase various goods, order work, and provide services. Such organizations receive funding from the budget, which limits their ability to freely choose suppliers on the open market. Instead, they must attract suppliers through government procurement procedures.

Those wishing to participate in government tenders must be legal entities that have no tax arrears or conflicts of interest with the customer, are not in the process of liquidation or bankruptcy, and are not associated with offshore companies. It is extremely important that the founder and chief accountant have not been convicted of economic crimes.

Orders in public procurement are available not only to companies, but also to individuals, including sole proprietors. For independent participants, this is a chance to increase the volume of business by receiving large contracts.

Public procurement is divided into two categories:

Competitive . Here, several suppliers participate, and there is a competition between them for the right to fulfill the order.

Non-competitive . Concluded with one supplier, but the total contract value does not exceed 600,000 rubles, and the annual purchase volume cannot exceed 2 million rubles.

We will consider competitive purchases, also known as tenders, in detail. They are conducted on electronic platforms in order to facilitate the search for customers and contractors to conclude profitable deals.

The term "tender" is not used in the legal norms of the Russian Federation. However, it denotes the selection of the best supplier based on competition. A company can become a leader in cost (the most affordable), in product quality, in speed or terms of service. The following act as initiators of competitions:

government structures and budgetary institutions for which procurement is regulated by Federal Law No. 44-FZ “On the contract system in the sphere of procurement of goods, works, services for state and municipal needs”;

organizations in which the state's share in the authorized capital exceeds 50% - in this case, purchases are regulated by Federal Law No. 223-FZ "On the purchase of goods, works, and services by certain types of legal entities";

Commercial organizations in Russia are subject to the provisions of the Civil Code regarding the regulation of procurement procedures of various types.

Depending on the specifics, tenders come in several formats, each of which has its own characteristics:

A competitive method in which the winner is determined based on the best conditions offered (it can last more than 10 days).

An electronic auction where the order goes to the supplier with the lowest price offered at the auction.

Request for quotation , where the supplier with the lowest starting price wins (requires submission of an application within a week).

Request for proposals , the conditions of which are similar to the competition (has a shortened period of up to 10 days).
