Digital information management tools have become essential to preventing and resolving disputes in construction projects. However, there are pitfalls to be aware of when implementing them, which may not always be obvious due to established electronic reporting practices.
The discussion on the negative aspects of implementation took place at the session “Prevent and Protect: The Role of Information Management in Dispute Resolution” from the Digital Construction Summit, where Sarah Keith, CTO of the consulting company HKA saudi arabia phone number Global and a member of the IM4Legal association, spoke together with George Emeny, Senior Account Manager at Ideagen Mail Manager.
According to Keith, a key pillar in the conflict resolution process is maintaining accurate and detailed records:
"Poor documentation can make it easier for lawyers to challenge evidence. Everything needs to be methodically documented, especially at key stages or significant events in the project. And these reports should become a kind of guide to help someone unfamiliar with it follow the sequence of events," she explained.
The expert added that digital tools and construction technologies are widely used in the construction industry today. Thanks to the ability of BIM tools to generate detailed and up-to-date reports, it is possible to obtain the most important evidence for resolving conflicts.
Models used during design and construction can provide critical information to assess whether a facility's design was executed with due care and attention to detail or whether it met project requirements. Information modeling also helps track design changes, which are often the cause of claims and can impact schedules and budgets.
Access to shared data environment
The CTO warned that problems could arise when using digital models and data warehouses:
“Access to this information is a constant challenge, especially if it is stored in a shared data environment (SDE) controlled by another party. Subcontractors and other participants must ensure that they have independent access to the system. Relying on the main contractor can be risky, especially in the event of a dispute or termination of the contract. Ideally, there should be a provision in the contract that allows access to the SDE in such cases,” she explained.
